1. Introduction

Pande & Associates (“Pande & Associates”, “we”, “us”, or “our”) respects the privacy of individuals who visit pandeassociates.in (the “Website”), contact us, request a consultation, interact with our AI Design Concierge, register for an account where enabled, participate in our Collaborative Network, or otherwise provide information to us.

These Terms are intended to operate alongside applicable Indian data-protection and information-technology laws and rules, including the Digital Personal Data Protection Act, 2023 and applicable rules, as and when applicable to the relevant processing.

2. Scope

These Terms apply to interactions with the Website and website-originated enquiries and interactions. They do not by themselves govern the detailed processing or obligations under a separately signed architectural, consultancy, design, turnkey, vendor, associate, employment, commercial, or project agreement where that agreement contains specific terms. In case of a conflict, the specific written agreement will govern to the extent permitted by law.

5. AI Design Concierge

The Website may provide an AI Design Concierge that asks users to select project categories, provide project context, identify priorities, and receive an initial design-oriented experience. Information submitted to the AI Design Concierge may be processed by Pande & Associates and, where applicable, technology providers supporting the feature.

The AI Design Concierge is an initial information and guidance tool. Its output is not a final architectural, engineering, structural, legal, statutory, financial, construction, safety, or regulatory determination. Users should not rely on an automated output as a substitute for professional review, site assessment, statutory verification, engineering analysis, or a signed project engagement.

6. Legal Bases / Grounds for Processing

Depending on the circumstances and applicable law, we may process personal data based on your consent, your request for a service or consultation, performance or steps connected with a contract, compliance with legal obligations, legitimate purposes permitted by applicable law, or other lawful grounds recognised by applicable data-protection law.

Where consent is required, we will seek it in an appropriate manner. Where consent is the basis of processing, you may withdraw consent subject to legal or contractual limitations and the consequences explained at the time of withdrawal.

7. Cookies and Similar Technologies

The Website may use strictly necessary cookies and, where enabled, analytics, preference, security, authentication, embedded-content, or other cookies. Third-party content such as social-media embeds may also place or access technologies subject to the third party’s own policies.

9. Collaborative Network and Associates

Pande & Associates may operate through a collaborative professional model in which individuals and external specialists may participate as associates, consultants, vendors, or other independent professional collaborators. Such persons are not automatically employees of Pande & Associates merely because they are listed on the Website, receive project work, access a project, or collaborate with the firm.

Where information is shared with a collaborator, the collaborator may process that information only for the authorised purpose and may be subject to separate contractual, professional, confidentiality, security, or data-protection obligations.

A person’s appearance in an associate or collaborative profile does not by itself constitute an employment relationship, agency relationship, partnership, joint venture, or authority to bind Pande & Associates.

10. Project and Client Confidentiality

Project drawings, plans, specifications, photographs, site information, client instructions, budgets, credentials, and other project materials may contain confidential or commercially sensitive information. We seek to handle such information appropriately and may restrict access to personnel, associates, consultants, vendors, and other persons who need it for the authorised purpose.

Users should not submit highly sensitive information through a general Website form unless requested or necessary. Project-specific confidentiality obligations should be documented in the applicable appointment, NDA, consultancy agreement, work order, or other written instrument.

11. Data Retention

We retain personal data only for as long as reasonably necessary for the purpose for which it was collected, for contractual and business records, to comply with legal or professional obligations, to resolve disputes, to enforce agreements, or for other lawful purposes. Retention periods may vary by category and project.

When information is no longer required, we may delete, anonymise, aggregate, or securely dispose of it, subject to lawful retention requirements and legitimate business needs.

12. Data Security

We use reasonable technical, organisational, and administrative safeguards appropriate to the nature of the information and risks involved. However, no internet transmission, cloud service, database, or electronic storage system can be guaranteed to be completely secure.

Users are responsible for protecting their account credentials and for notifying us promptly if they suspect unauthorised access or misuse of their account.

The Website may contain links, embeds, maps, social-media content, payment or scheduling services, analytics services, authentication services, or other third-party functionality. Third parties may collect or process information independently. Their practices are governed by their own privacy notices and terms, not these Terms.

Pande & Associates is not responsible for the privacy, security, content, availability, or practices of independent third-party websites or services.

Requests may be submitted using the contact details in Section 18. We may need to verify identity before acting on a request and may retain information where legally required or where a lawful exception applies.

The Website is not intended to knowingly collect personal data from children in circumstances where such collection is prohibited by applicable law. If you believe a child has provided personal data to us improperly, contact us so that we can assess and take appropriate action.

16. International / Cross-Border Processing

Some technology or service providers may process information from locations outside India. Where applicable, such processing will be undertaken subject to applicable law, contractual safeguards, and any restrictions or conditions imposed by the competent authorities.

17. Changes to these Terms

We may update these Terms from time to time to reflect changes in the Website, business practices, technology, or applicable law. The updated version will be posted on the Website with a revised effective or update date. Continued use of the Website after an update constitutes acknowledgement of the updated Terms to the extent permitted by law.
